A. Selecting a Property

Warmingham advertise rental properties through various media:

B. Offers

After you have found a suitable property we will put forward the terms of your offer to the Landlord.

Please note acceptance of your offer is subject to receipt of satisfactory references and the signing and dating of tenancy agreements by both parties.

C. Holding Deposit

Once you have found a property Warmingham will ask you to pay a holding deposit of at least £100. References will then be take up and the Landlord asked if they will take the property off the market, although there is no guarantee that they will agree to do so.

If your application is successful then the £100 holding deposit will be put towards the main deposit against dilapidations, damages, etc. which Warmingham hold during the tenancy. Should the letting not proceed then the holding deposit may be forfeited.

D. References

Warmingham use a specialised credit-referencing agency, HomeLet, who normally give their recommendation within 2-3 days. It may then take a further 3-5 days to obtain approval from the Landlord. If you are not accepted for the letting, you will be advised whether you may nominate a guarantor on whom we will require satisfactory references. You should note that reference charges are non-refundable.

E. Expenses

Once the negotiations have been completed and the terms of the tenancy agreed it is important to note that the following payments will be required before the Agreement is drawn up:

  1. An initial rent payment (calendar month)
  2. A deposit (generally equivalent to one and a half months rent)
  3. An administration fee for the legal document/Tenancy agreement
  4. A charge for credit reference

The first payment is payable by cheque, bankers draft or cash and thereafter payments will be made by standing order.

F. Deposit

The deposit is usually the equivalent of one and a half month's rental, and held by Warmingham as Stakeholders during the tenancy, to be returned after the tenancy ends subject to the terms of the Tenancy Agreement. Deposits may never be used as rental due, either during or at the end of a tenancy. It should be noted that we will require the mutual written agreement of yourself and the Landlord as to the disbursement of the deposit monies at the end of the tenancy and we will not be responsible for arbitration or mediation in respect of any dispute. It should also be noted that in the case of properties which have a formal check in procedure (this will depend on your landlord) a check out will be carried out when you leave and the cost of this will be taken from the deposit. The check in is paid for the landlord.

G. Tenancy Agreements

Our legal advisor has prepared our Tenancy Agreement. It forms a legal contract between the tenant and the Landlord. Please read it carefully and whilst we will be happy to explain the Tenancy Agreement to you, if you have any queries, you should consult an independent legal adviser.

Private Tenant
Where the tenancy is to be in your name or names; the type of Agreement will be an Assured Shorthold Tenancy.

Company Let
In the event that your employer is acting as the tenant an Agreement is drawn up that identifies the Company as the tenant and you as the occupant. We will require written confirmation to this effect. The Agreement must be signed and witnessed.

H. Inventory

An inventory is prepared before the tenancy at the expense of the Landlord. When the tenancy commences an independent Inventory Clerk checks the inventory through (Check-in) with the tenant, at the Landlord's expense. At the termination of the tenancy, the inventory will be checked again (Check-out) with the tenant and Inventory Clerk, at the expense of the tenant.

I. Rent Payments

Rent is payable in advance. After the first payment (due with the deposit), during the tenancy rent is required to be paid by standing order, drawn from the tenant's bank three days before the due date in order to allow time to clear.

J. Utilities and Other Costs

The tenant is responsible for the payment of utilities (gas, electricity, water, oil, and telephone) and for the transfers of these services. Tenants are also responsible for the payment of Council Tax during the tenancy. It is the tenant's responsibility to provide a television license. Non-payment of this fee is an offence and carries a fine.

K. Insurance

Whilst the Landlord is responsible under the terms of the Agreement to provide building and contents insurance, he is not liable for your own possessions. We therefore recommend that you make your own arrangements for insuring all your personal belongings and any accidental damage caused by you to the Landlords possessions or premises under an "all risks" policy. We recommend HomeLet's policy.

L. Property Management

While we can find you a home, Warmingham may not necessarily be responsible for management during the tenancy. You will be informed who will be managing the property at the commencement of the tenancy. When we act as managing agents, any problems you have relating to the property must be reported to us immediately. This will ensure that the matter is dealt with in accordance with the Landlord's instructions. Managed properties will also be subject to quarterly visits by a member of the lettings team.

M. Termination of Tenancy

Towards the end of your tenancy Warmingham will contact you to ascertain your future requirements. If you wish to terminate your tenancy Warmingham will require written notice two months prior to the date you wish to vacate, and to reach Warmingham before the anniversary date of the Agreement. Should the tenancy be terminated an inventory check-out will be arranged at the expiry of the tenancy. You will be advised of the check-out procedures required of you and the time of the Inventory Clerk's visit. The property should be ready to hand over in a clean and tidy condition and the garden tended. We make this point as costs can be incurred if it is necessary to employ the services of professional cleaners and gardeners.

All keys must be given to the Inventory Clerk at the time of the check-out and you will have no further access to the property.
